These Terms govern your access to the StockIQ website, portal, installed application, research tools, alerts, support, and simulated-trading features (collectively, the “Service”).
The short version: StockIQ is an educational research tool—not a broker, adviser, exchange, or trading system. Verify all information independently and make your own decisions. By accessing or using the Service, you agree to these Terms and the Privacy Policy.
1. Acceptance and scope
By accessing or using the Service, requesting an account, or downloading an installed StockIQ application, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.
StockIQ may offer beta, preview, experimental, or invitation-only features. Those features are part of the Service and are governed by these Terms unless separate terms are presented.
2. Eligibility and access
You must be at least 18 years old and legally able to enter into these Terms. Access may be private, invitation-only, permission-based, or limited by account role. StockIQ may approve or deny access requests in its discretion and may change, restrict, suspend, or discontinue access as reasonably necessary to operate or protect the Service.
3. Educational research only
StockIQ provides general educational information, market research, screening, scoring, commentary, alerts, watchlists, portfolio-analysis tools, and simulated-trading features. StockIQ:
is not a broker-dealer, investment adviser, financial planner, exchange, bank, tax adviser, accountant, or law firm;
does not provide personalized financial, investment, legal, accounting, or tax advice;
does not know your complete circumstances, objectives, risk tolerance, tax position, or liquidity needs;
does not recommend, solicit, execute, route, clear, custody, or settle real securities or cryptocurrency transactions; and
does not promise that any score, signal, alert, target, estimate, scenario, model, or research output will be accurate or profitable.
Investing involves risk, including loss of principal. Past performance, historical patterns, paper results, backtests, analyst targets, model outputs, and simulated outcomes do not guarantee future results. You are solely responsible for independently evaluating information and for every decision or transaction you make. Consider consulting appropriately licensed professionals.
4. Accounts and security
You must provide accurate account information, keep it current, protect passwords, MFA credentials, devices, and reset links, and promptly report suspected unauthorized access. You are responsible for activity under your credentials. Do not share a personal account unless StockIQ expressly designates it as shared, and do not attempt to access another user’s information or permissions.
Do not provide brokerage passwords, bank credentials, Social Security numbers, government IDs, full account numbers, payment-card information, or other information the Service does not request. Portfolio entries and paper trades are records and simulations only; they do not connect to or control a brokerage account.
5. Acceptable use
You may use the Service only for lawful personal or authorized internal research. You may not:
violate law, another person’s rights, market rules, or contractual restrictions;
use the Service for manipulation, fraud, unlawful trading, harassment, malware, credential theft, or unauthorized surveillance;
probe, scan, disrupt, overload, scrape, crawl, or reverse engineer the Service except where applicable law expressly permits it;
use automated means to extract, reproduce, train on, resell, syndicate, or commercially exploit the Service or its data without written permission;
upload content you do not have the right to use or content that is unlawful, deceptive, or harmful; or
misrepresent StockIQ research as individualized professional advice or as a guaranteed result.
6. Your content and feedback
You retain ownership of notes, watchlists, portfolio entries, thesis drafts, support messages, and other content you submit (“Your Content”). You grant StockIQ a nonexclusive, worldwide, royalty-free license to host, copy, process, display, and transmit Your Content only as reasonably needed to operate, secure, support, and improve the Service and as described in the Privacy Policy. You represent that you have the necessary rights to submit Your Content.
If you provide suggestions or feedback, StockIQ may use them without restriction or compensation, but is not required to do so.
7. Market data, models, AI, and third parties
The Service may rely on exchanges, issuers, regulators, news publishers, market-data vendors, analysts, calendar providers, artificial-intelligence services, and other third parties. Quotes and outputs may be delayed, incomplete, adjusted, estimated, generated, unavailable, or wrong. Dates, prices, corporate actions, fundamentals, earnings information, tax-lot calculations, and alerts must be checked against authoritative sources before use.
Scores, narratives, classifications, forecasts, and AI-assisted outputs are automated research aids. They may contain errors or omit important context. No output is a direction to buy, sell, hold, size, or time an investment.
Third-party links, content, services, and downloads are governed by their own terms and policies. StockIQ does not control or endorse them and is not responsible for their availability, security, content, or practices.
8. Simulated trading and alerts
Paper trades, simulated limit orders, portfolios, gains, losses, and performance figures are hypothetical. Simulations may not reflect liquidity, spreads, slippage, taxes, fees, halts, order priority, partial fills, corporate actions, or real execution. They cannot be treated as actual transaction records or proof of achievable performance.
Alerts and reminders may be late, duplicated, missing, or undelivered. Do not rely on the Service for time-critical action, regulatory compliance, tax deadlines, risk controls, or monitoring an actual account.
9. StockIQ materials and license
The Service, including its software, design, branding, text, organization, research frameworks, and original content, is owned by StockIQ or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, StockIQ grants you a limited, revocable, nonexclusive, nontransferable license to use the Service for its intended purpose. No other rights are granted. Third-party data and content remain the property of their respective owners.
10. Changes, availability, and termination
StockIQ may add, remove, correct, update, limit, or discontinue features or data sources. The Service may experience outages, delays, data loss, or security incidents, and StockIQ does not guarantee uninterrupted availability or preservation of device-stored or cloud-synced information. Keep independent copies of information you need.
You may stop using the Service at any time. StockIQ may suspend or terminate access for violation of these Terms, security or legal risk, inactivity, discontinuation, or other legitimate operational reasons. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnity, and dispute provisions—survive termination.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, DATA, OUTPUTS, DOWNLOADS, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” STOCKIQ AND ITS PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND RESULTS. STOCKIQ DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT INFORMATION WILL MEET YOUR NEEDS.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOCKIQ AND ITS OWNER, CONTRIBUTORS, PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, OPPORTUNITIES, DATA, OR GOODWILL; INVESTMENT LOSSES; TRADING LOSSES; TAX CONSEQUENCES; OR DAMAGES ARISING FROM RELIANCE ON DATA, OUTPUTS, ALERTS, LINKS, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID STOCKIQ FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited.
13. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless StockIQ and its owner, contributors, providers, and licensors from third-party claims, losses, liabilities, and reasonable costs (including attorneys’ fees) arising from your unlawful use of the Service, Your Content, your violation of these Terms, or your violation of another person’s rights.
14. Disputes and applicable law
Before filing a claim, you and StockIQ agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice. Send notice using the contact information below and include enough detail to understand and address the issue.
These Terms are governed by applicable United States law, without regard to conflict-of-law principles, except where the law of your jurisdiction requires otherwise. Any dispute must be brought in a court of competent jurisdiction. Nothing in these Terms prevents either party from seeking emergency injunctive relief or limits non-waivable consumer rights.
15. General terms
These Terms and the Privacy Policy are the entire agreement between you and StockIQ concerning the Service, unless separate written terms apply. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions remain effective. StockIQ’s failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; StockIQ may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Service. Headings are for convenience only.
16. Changes to these Terms
StockIQ may update these Terms as the Service or law changes. The effective date will be revised, and material changes may be announced in the portal or by email when appropriate. Changes apply prospectively. Your continued use after updated Terms take effect constitutes acceptance; if you do not agree, stop using the Service.
